LEGAL REQUIREMENTS for FILING BANKRUPTCYMeans (Income) TestingUnder the new bankruptcy law that went into effect in October of 2005, bankruptcy applicants who wish to file under Chapter 7 must meet certain eligibility requirements based on a "means test." Under the means test, if your current monthly income is less than the median income in your state, you can file for bankruptcy under Chapter 7. Otherwise, additional calculations are performed to determine if you can qualify for Chapter 7 by documenting certain allowable expenses. We will help you determine if Chapter 7 is feasible for you. Credit Counseling The new law requires credit counseling before and after the case is filed. We can give you the most convenient methods to fulfill this requirement, which include online and telephone options available in the comfort of your own home and on your schedule. We will help you through this process as part of our service. Disclosures When you come to our office, we will give you some documents to read explaining the types of bankruptcies available and some of the relevant legal provisions required by the United States Bankruptcy Code. You will be asked to sign a statement that you have read and understand the disclosures. We will also sign an agreement with you regarding our representation and fees.
